Now Book It — Terms of Service (Consumer / Diner Facing)

About Now Book It
Now Book It Pty Ltd (ABN 33 607 322 092) (“Now Book It”, “we”, “us”, “our”) provides an online restaurant and venue reservation platform that enables diners (“you”, “your”) to discover, search, and book tables at participating venues across Australia, New Zealand, Canada, and the United States.By accessing or using the Now Book It platform — including our website, mobile applications, booking widgets embedded on third-party sites, or any reservation made via Google’s Reserve with Google service — you agree to be bound by these Terms of Service. By completing a booking, you confirm that you have read and accepted these Terms.By completing a booking, you confirm that you have read and accepted these Terms.If you do not agree to these Terms, please do not use our service.
Making a Reservation
2.1 How reservations work
Now Book It facilitates reservations on behalf of participating venues. When you submit a booking request, your reservation is made directly with the venue. Now Book It is not a party to the dining contract between you and the venue.
2.2 Confirmation
Reservations are not confirmed until you receive a booking confirmation via email or SMS. Please check your confirmation details carefully — including date, time, party size, and any special requirements.
2.3 Reservation use
You agree to use our reservation service only to book tables at venues and then honour those reservations by:
Arriving at the venue on time
Ordering and paying for food and beverages in accordance with the venue’s requirements
Not making multiple reservations for the same time and date for personal use
Resale or commercial on-sale of reservations is strictly prohibited.
Bookings via Reserve with Google
Where you make a reservation through Google’s Reserve with Google service (for example, by using the “Book Now” or “Reserve a Table” button on Google Search or Google Maps), the following additional terms apply:
Google collects your contact and booking details at the time of booking and shares them with Now Book It for the purpose of fulfilling your reservation. Google’s collection and handling of your data is governed by Google’s Privacy Policy.
Once Now Book It receives your booking data from Google, we handle it in accordance with our own Privacy Policy and these Terms.
The same cancellation, no-show, and payment policies that apply to bookings made directly through Now Book It also apply to bookings made via Reserve with Google.

Cancellations and No-Shows
Cancellation and no-show policies are set by each individual venue. Where a venue applies a cancellation policy, you will be notified of the policy at the time of booking, prior to confirming your reservation.If card details are required, you may be charged if you:
Fail to cancel within the required notice period
Do not arrive without prior notice
Now Book It is not responsible for any cancellation or no-show fees charged directly by a venue. Please direct any disputes regarding such charges to the venue.
Payment
Now Book It does not charge diners for making a reservation. However, some venue services or experiences may require prepayment or a deposit at the time of booking. In such cases:
Payment details are collected securely and processed by our third-party payment processor
Now Book It does not store full payment card details
The venue is responsible for any charges applied, including pre-paid experiences, deposits, and cancellation fees
Where Now Book It facilitates payment on behalf of a venue, additional payment terms may apply and will be presented to you at the time of checkout. The amount charged will always match the amount disclosed during the booking process.
SMS Communications
Where you opt in to SMS updates at the time of booking, Now Book It and/or the venue may send you transactional SMS messages related to your reservation — such as confirmations, reminders, and cancellation notices.
To opt out of SMS at any time, reply STOP to any SMS you receive. Reply HELP for assistance. Message frequency varies. Message and data rates may apply.
US & Canada: SMS messaging complies with the Telephone Consumer Protection Act (TCPA) and Canada’s Anti-Spam Legislation (CASL).

Intellectual Property
All content on the Now Book It platform — including text, graphics, logos, software, and data — is the property of Now Book It or its licensors and is protected by applicable intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from any Now Book It content without our express written consent.
User Content and Conduct
You agree not to use the Now Book It platform to submit false, fraudulent, or misleading reservation requests, or to engage in any conduct that disrupts or interferes with the platform or the experience of other users or venues.
Privacy
Your use of Now Book It is also governed by our Privacy Policy, available at nowbookit.com/privacypolicy. By using our services, you consent to the collection and use of your personal information in accordance with our Privacy Policy.Where your booking originates from a third-party platform (such as Reserve with Google), your data may first be collected by that platform and then shared with Now Book It. Please refer to the relevant platform’s privacy policy for details on their data practices.If you wish to opt out of marketing communications or exercise any other privacy rights, please visit nowbookit.com/opt-out or contact us at legal@nowbookit.com.
Limitation of Liability
To the fullest extent permitted by applicable law:
Now Book It provides its platform on an “as is” and “as available” basis without warranties of any kind
Now Book It is not liable for the acts or omissions of any venue, including the quality of food or service, changes to hours or menus, or any venue’s failure to honour a reservation
Now Book It’s total liability to you for any claim arising out of or in connection with these Terms shall not exceed the amount (if any) paid by you to Now Book It in connection with the relevant booking
Consumer rights under applicable law remain unaffected.
Indemnification
You agree to indemnify and hold harmless Now Book It and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including legal fees) arising out of or relating to your use of the Now Book It platform, your violation of these Terms, any content you submit, or your violation of any third-party rights.
Modification and Termination
Now Book It may update or amend these Terms at any time. Where we make material changes, we will post an updated version on our website and update the effective date. Your continued use of the platform following any changes constitutes your acceptance of the updated Terms.Now Book It may suspend or terminate your access to the platform at any time if we reasonably believe you are in breach of these Terms.
Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales, unless otherwise required by applicable law in your jurisdiction.If you are located in the United States, Canada, or New Zealand, nothing in these Terms limits any mandatory consumer protection rights you may have under the laws of your state, province, or country of residence.
